SECTION 1. INTRODUCTION / POLICY OVERVIEW
This Shipping and Returns Policy ("Policy") is published by DMDC™ Designs L.L.C. dba DMDC™ DISTINCT™ ("Company," "we," "us," or "our"), a limited liability company organized and operating under the laws of the State of California. DMDC™ Designs L.L.C. dba DMDC™ DISTINCT™ is headquartered in California and conducts business through its website and/or online sales platform.
This Policy governs all purchases made through the Company's website and/or sales platform and sets forth the terms and conditions applicable to order processing, shipping, returns, refunds, exchanges, and related matters. By completing a purchase through the Company's website or platform, the customer acknowledges having read, understood, and agreed to the terms and conditions of this Policy in their entirety.
This Policy is incorporated by reference into the Company's Terms & Conditions and is to be read in conjunction therewith. In the event of any conflict between this Policy and the Terms & Conditions, the Terms & Conditions shall control unless this Policy expressly provides otherwise.
IMPORTANT NOTICE TO CALIFORNIA CONSUMERS: This Policy has been prepared in compliance with applicable California consumer protection laws, including but not limited to the California Consumer Legal Remedies Act (CLRA), the California Consumer Privacy Act (CCPA), California's automatic renewal law, and related statutes and regulations. Nothing in this Policy is intended to limit, waive, or circumvent any rights afforded to consumers under California law.
SECTION 2. ORDER PROCESSING TIME
The following provisions govern the processing of orders placed through the Company's website and/or platform. Customers are advised to carefully distinguish between processing time and shipping/transit time, as these represent two separate and DISTINCT™ phases of order fulfillment.
-
Processing Period. Orders are processed within three (3) to five (5) business days from the date of order confirmation. For purposes of this Policy, "business days" means Monday through Friday, excluding weekends and federally recognized public holidays.
-
Shipping Confirmation. Upon fulfillment and handoff of the order to the designated carrier, the customer will receive a shipping confirmation email containing a tracking number that may be used to monitor the status of the shipment.
-
After-Hours and Weekend Orders. Orders placed after business hours, on weekends, or on federal public holidays will begin processing on the next available business day. The processing clock does not begin until the next business day.
-
Processing Delays. The Company reserves the right to delay order processing in the event of: (i) payment authorization or verification issues; (ii) unusually high order volume; or (iii) circumstances beyond the Company's reasonable control, including force majeure events as described in Section 3(e) of this Policy. The Company will make reasonable efforts to notify affected customers of material processing delays.
-
Processing Time Distinguished from Transit Time. The processing timeframes specified in this Section do not include carrier transit or delivery time. Estimated transit and delivery windows are addressed separately in Section 3 of this Policy.
-
SECTION 3. SHIPPING TIMES & METHODS
The following shipping timeframes and service options apply to orders fulfilled and shipped by DMDC™ Designs L.L.C. dba DMDC™ DISTINCT™. All timeframes are estimates only and commence upon completion of the processing period described in Section 2.
-
Domestic Shipping (United States). Standard domestic shipping within the contiguous United States carries an estimated transit time of five (5) to ten (10) business days following the completion of order processing. Delivery timeframes to Alaska, Hawaii, U.S. territories, and APO/FPO addresses may vary and are subject to carrier capabilities.
-
Expedited and Express Shipping. Expedited and express shipping options may be available at checkout where offered by the Company. Estimated delivery timeframes for expedited services will be displayed at checkout prior to order completion. Availability of such services is not guaranteed for all destinations or products.
-
International Shipping. For orders shipped to destinations outside the United States, estimated transit times vary by destination country and are subject to customs clearance processing. International shipments generally carry an estimated transit time of ten (10) to twenty-one (21) business days following the completion of order processing. These estimates are not guaranteed.
-
Estimates Only — No Guarantee. All shipping timeframes communicated by the Company, whether on the website, at checkout, or in any correspondence, are estimates only. Such timeframes are not contractual commitments or delivery guarantees. The Company expressly disclaims any liability for shipping delays, whether caused by the carrier, customs authorities, weather events, natural disasters, public health emergencies, governmental actions, or any other circumstances beyond the Company's reasonable control.
-
Carrier Force Majeure. The Company shall not be liable for any delay or failure to deliver arising from acts of God, acts of government, pandemics, strikes, labor disputes, transportation disruptions, extreme weather conditions, or other events outside the Company's control. Such events shall not constitute a breach of this Policy or of any order agreement.
-
Shipping Rates. Shipping rates are calculated at checkout and are based on factors including but not limited to order weight, package dimensions, delivery destination, and the shipping service selected by the customer. Shipping rates are subject to change without prior notice and will be displayed to the customer prior to order confirmation.
SECTION 4. CARRIER LIABILITY DISCLAIMER
This Section governs the allocation of risk and responsibility once an order has been tendered to the designated carrier for shipment.
(i) Check with neighbors, building management, leasing office, or other persons who may have accepted delivery on the customer's behalf;
(ii) Contact the applicable carrier directly to initiate a delivery investigation or trace request; and
(iii) Notify the Company in writing at support@dmdcdistinct.com within seven (7) calendar days of the marked delivery date, providing the order number and a description of the situation.
SECTION 5. CUSTOMER RESPONSIBILITY
Customers bear certain responsibilities in connection with the placement of orders and receipt of shipments as set forth below. DMDC™ Designs L.L.C. dba DMDC™ DISTINCT™ shall not be held liable for losses or delivery failures arising from the customer's failure to comply with the responsibilities described in this Section.
-
Accuracy of Shipping Information. The customer is solely responsible for providing accurate, current, and complete shipping information — including recipient name, street address, unit or apartment number, city, state, ZIP code, and country — at the time of purchase. The Company will ship orders to the address provided by the customer at checkout and bears no responsibility for verifying the accuracy of customer-submitted address information.
-
Incorrect Address Responsibility. DMDC™ Designs L.L.C. dba DMDC™ DISTINCT™ is not responsible for orders shipped to an incorrect, incomplete, or undeliverable address provided by the customer. If a package is undeliverable, refused, or returned to the Company as a result of an incorrect or incomplete address submitted by the customer, the customer shall bear sole responsibility for any resulting loss, delay, or additional cost.
-
Re-Shipping Fees. If a package is returned to the Company due to an incorrect address, refused delivery, or failed delivery attempts attributable to the customer, the customer will be responsible for all applicable re-shipping fees. The Company reserves the right to: (i) deduct re-shipping costs from any refund otherwise due to the customer; or (ii) require payment of re-shipping fees in full before re-dispatching the order.
-
International Customs, Duties, and Taxes. For international orders, the customer is solely responsible for understanding, complying with, and bearing the cost of all applicable import duties, customs fees, tariffs, value-added taxes (VAT), and any other fees or charges imposed by the destination country's governmental authorities. The Company does not pre-pay, collect, or reimburse any such costs. Customs delays attributable to governmental processing are outside the Company's control and do not entitle the customer to a refund or cancellation.
-
Post-Delivery Inspection. Customers must inspect their orders promptly upon receipt. Any issues, including physical damage to items, defects in materials or workmanship, or discrepancies between the order and the items received (including missing items), must be reported to the Company in writing within seven (7) calendar days of the confirmed delivery date. Failure to report issues within this window may result in the Company being unable to provide a remedy. (See also Section 8 — Defective or Damaged Items.)
SECTION 6. RETURNS — ELIGIBILITY & GENERAL TERMS
DMDC™ Designs L.L.C. dba DMDC™ DISTINCT™ accepts returns on eligible items in accordance with the terms and conditions set forth in this Section. Returns that do not comply with these terms will not be accepted.
(i) The item is unused, unworn, unwashed, and in its original, unaltered condition;
(ii) The item is in its original packaging, with all tags, labels, hang tags, accessories, and accompanying materials intact and unremoved; and
(iii) The item is not a non-returnable item designated under Section 7 of this Policy.
SECTION 7. NON-RETURNABLE ITEMS
The following categories of items are designated as final sale and are not eligible for return, exchange, or refund under any circumstances, except as expressly required by applicable California or federal law, or in the case of a verified manufacturing defect as provided in Section 8 of this Policy:
-
Customs, personalized, or made-to-order items, including any items produced or modified to the customer's specifications;
-
Digital products or downloadable content of any kind, once delivered or made available;
-
Intimate apparel, swimwear, undergarments, and similar items, for reasons of hygiene and public health;
-
Opened, used, or unsealed beauty products, skincare products, cosmetics, or personal care products;
-
Items designated as "Final Sale" or "Clearance" on the product listing page and/or at checkout at the time of purchase;
-
Gift cards, store credit, and promotional vouchers;
-
Items returned after the expiration of the thirty (30) day return window;
-
Items that have been altered, washed, dry-cleaned, repaired, or otherwise modified by the customer after delivery;
-
Items damaged through misuse, improper handling, normal wear and tear, accident, or customer negligence; and
-
Hazardous materials, perishable goods, or items otherwise prohibited from return by applicable law or regulation.
The Company will clearly designate non-returnable items on the applicable product page and/or at checkout prior to purchase. By completing the purchase of a non-returnable item, the customer expressly acknowledges and accepts the item's final-sale status and waives any right to return, except as may be required by law or as provided in Section 8.
SECTION 8. DEFECTIVE OR DAMAGED ITEMS
Notwithstanding any other provision of this Policy, including the non-returnable item designations in Section 7, the following terms apply where a customer receives an item that is defective in materials or workmanship, was damaged in transit prior to delivery, or is materially different from what was ordered.
(i) Notify the Company in writing within seven (7) calendar days of the confirmed delivery date;
(ii) Submit a claim to support@dmdcdistinct.com with the email subject line: "Defective/Damaged Item – Order #[ORDER NUMBER]"; and
(iii) Include the following information and documentation with the claim: (A) the customer's full name; (B) the applicable order number; (C) a clear written description of the defect, damage, or discrepancy; and (D) clear photographic evidence of the defective or damaged item and, where applicable, of the item's original packaging as received.
(i) Replacement of the item with an identical or substantially similar item, subject to availability;
(ii) Issuance of store credit in the amount of the original purchase price of the defective or damaged item; or
(iii) A full refund of the original purchase price to the original payment method used at checkout, in accordance with Section 10 of this Policy.
SECTION 9. RETURN PROCESS
Customers seeking to initiate a return must follow the six-step process described below. Failure to adhere to this process may result in the return being rejected and the forfeiture of any applicable refund or exchange.
-
Step 1 — Request Authorization. Contact DMDC™ Designs L.L.C. dba DMDC™ DISTINCT™ at support@dmdcdistinct.com to request a Return Merchandise Authorization (RMA) within the thirty (30) calendar day return window. The request must include: (a) the order number; (b) the specific item(s) to be returned; and (c) the reason for the return. Do not ship any item back to the Company before receiving an approved RMA number.
-
Step 2 — Receive RMA Approval. Upon review and approval of the RMA request, the customer will receive written confirmation containing the assigned RMA number and detailed return shipping instructions via email. The Company reserves the right to deny RMA requests for items that do not satisfy the eligibility criteria in Section 6 or that are designated as non-returnable under Section 7.
-
Step 3 — Package Your Return. Securely pack the item(s) in original packaging where available, or in equivalent protective packaging sufficient to prevent damage during return transit. The assigned RMA number must be clearly written or printed on the exterior of the return package. Failure to include the RMA number may result in the package being refused or unprocessed upon receipt.
-
Step 4 — Ship the Return. Unless the return is the result of a verified Company error or a confirmed defect or damage claim under Section 8, the customer is solely responsible for all return shipping costs. The Company strongly recommends using a trackable shipping method and retaining proof of shipment. The Company is not responsible for items lost, damaged, or delayed during return transit, and will not credit the customer for any item not received.
-
Step 5 — Inspection & Processing. Upon receipt of the returned item(s), the Company will conduct an inspection within five (5) to seven (7) business days to verify that the item(s) meet the eligibility criteria set forth in Section 6. The Company reserves the right to deny a refund, exchange, or store credit if the returned item(s) do not satisfy the eligibility requirements upon inspection. The customer will be notified of the outcome of the inspection.
-
Step 6 — Refund or Exchange. If the return is approved following inspection, the applicable refund will be processed, or the exchange will be initiated, in accordance with Section 10 (Refunds) or Section 11 (Exchanges) of this Policy, as applicable.
SECTION 10. REFUNDS — METHOD, TIMING & CONDITIONS
The following terms govern the issuance of refunds by DMDC™ Designs L.L.C. dba DMDC™ DISTINCT™ upon approval of an eligible return.
(i) Credit or Debit Card: Refunded to the same card used for purchase. Additional processing time of three (3) to seven (7) business days may be required by the customer's card-issuing bank or financial institution for the refund to appear on the account statement.
(ii) PayPal or Digital Wallet: Refunded to the same PayPal account or digital wallet used at checkout. Processing timelines vary by platform and are outside the Company's control.
(iii) Store Credit or Gift Card: Where the original purchase was made using store credit or a gift card, the refund will be issued as store credit to the customer's account on file.
(iv) Buy Now, Pay Later (BNPL) Services (including but not limited to Afterpay, Klarna, Affirm, and similar services): Refunds will be processed in accordance with the terms of the applicable BNPL provider's agreement. Customers are advised to review their BNPL agreement for applicable refund terms, timelines, and conditions, as the Company does not control third-party BNPL platforms.
SECTION 11. EXCHANGES
-
Availability. The Company offers exchanges for eligible items of equal or lesser value, subject to product availability at the time the exchange request is processed. The Company cannot guarantee the availability of any specific item or variant at the time of exchange processing.
-
Exchange Process. To request an exchange, the customer must follow the return process set forth in Section 9 and clearly indicate in the RMA request the specific item(s) desired as the exchange. Submission of an exchange request does not reserve or guarantee the availability of the requested item.
-
Unavailability of Exchange Item. If the desired exchange item is unavailable at the time of processing, the Company will, at its election and in consultation with the customer, issue either: (i) store credit in the amount of the original purchase price of the returned item; or (ii) a refund in accordance with Section 10 of this Policy.
-
Exchange Eligibility. Exchanges are subject to the same eligibility criteria as returns, as set forth in Section 6 of this Policy. Items designated as non-returnable under Section 7 are not eligible for exchange, except as required by applicable law or as provided under Section 8.
SECTION 12. ORDER CANCELLATIONS
-
Pre-Processing Cancellations. Orders may be cancelled at no charge if the cancellation request is received and confirmed by the Company before the order has entered the processing stage. Upon cancellation of a pre-processing order, the Company will issue a full refund to the original payment method in accordance with Section 10.
-
Post-Processing and Shipped Orders. Once an order has entered processing or has been handed off to the carrier for shipment, the order cannot be cancelled. Customers seeking a remedy for a shipped order must follow the return process set forth in Section 9 upon receipt of the item(s), subject to the eligibility criteria and conditions of this Policy.
-
Cancellation Request Procedure. To request a cancellation, the customer must contact the Company immediately at support@dmdcdistinct.com with the applicable order number included in the subject line of the communication. Cancellation requests transmitted by any means other than direct written contact with the Company are not guaranteed to be received or acted upon in time.
-
No Guarantee of Cancellation. Cancellation requests are not guaranteed and are subject to the processing status of the order at the time the Company receives and reviews the request. The Company will make reasonable efforts to accommodate timely cancellation requests but assumes no liability for orders that cannot be cancelled due to fulfillment status.
SECTION 13. LOST, STOLEN, OR UNDELIVERED PACKAGES
(i) Verify the current tracking status using the tracking number provided in the shipping confirmation email, and allow a minimum of three (3) additional business days beyond the estimated delivery date for carrier resolution before escalating;
(ii) Contact the applicable carrier directly to file a formal trace or missing package claim; and
(iii) Notify the Company in writing at support@dmdcdistinct.com, providing the order number and, once obtained, the carrier's claim reference or trace number.
SECTION 14. CALIFORNIA CONSUMER RIGHTS
-
Statutory Rights Preserved. To the extent required by California law, including but not limited to the California Consumer Legal Remedies Act (Civil Code §§ 1750 et seq.), the Consumers Legal Remedies Act, the California Unfair Competition Law (Business and Professions Code §§ 17200 et seq.), and all applicable regulations and enforcement guidance, customers located in California retain all statutory rights with respect to defective merchandise, deceptive trade practices, and related consumer protections. Nothing in this Policy is intended to, nor shall it be construed to limit, waive, or supersede any such statutory rights.
-
